$2,500,000 Settlement for Wrongful Death of Nine Year Old In Motor Vehicle Collision
The plaintiff was the personal representative of the estate of a nine year old minor who was killed in a motor vehicle collision with another motor vehicle. The plaintiff alleged the driver of the defendant’s vehicle negligently made an improper lane change on an interstate highway in poor weather conditions striking plaintiff’s vehicle causing the driver to lose control resulting in the vehicle rolling over and the minor’s death . The minor was survived by his parents and a sibling. The plaintiff filed suit against the driver and owner of the offending motor vehicle.The defendants denied negligence and instead argued that it was the driver of the plaintiff’s vehicle that made the improper lane change which caused the accident and that the child was not properly restrained. The case settled for $2,500,000 prior to trial.
