$10.0 Million Settlement in Medical Negligence Action Against Physician for Negligent Heart Surgery

The Plaintiff was an adult male who suffered from aortic valve disease. As a result, he needed a mitral valve replacement procedure . Plaintiff alleged that the cardiovascular surgeon negligently performed the procedure resulting in further damage to the heart. In order to treat this heart damage and save the Plaintiff’s life he required increased amounts of vasopressors. Although the Plaintiff did survive, the vasopressors led to an ischemia of both hands and feet resulting in their amputation. The defense responded by denying that the surgery was performed improperly and instead arguing that the Plaintiff’s loss of limbs was due to heparin induced thrombocytopenia which was unforeseeable and unavoidable. The case settled for $10.0 million prior to trial.
