$1,000,000 Settlement in Medical Malpractice Action Against Physicians and Hospital for Failing to Timely Diagnose and Treat Aspirin Overdose In Infant

The plaintiff was an infant who presented to a hospital following an accidental aspirin tablet ingestion. Over the next 3 hours the infant started showing signs and symptoms of aspirin poisoning. However, there was a delay in recognizing, diagnosing and properly treating this condition for over 14 hours. Due to the delay, the aspirin was metabolized and the only treatment available to combat the toxicity was dialysis. However, the child died before the treatment could be administered. The cause of death was aspirin toxicity. The child was survived by his parents. The plaintiff alleged that the defendant physicians and hospital were negligent in the diagnosis and treatment of aspirin toxicity which caused the death of the child. The defendants argued they were not negligent and that no treatment would have prevented the child’s death. The case settled for $1,000,000 against the physicians and hospital prior to trial.
