$2,325,000 Settlement in Negligent Security Action Against Apartment Complex

The plaintiff was living with his girlfriend when her unit was invaded by masked gunmen in order to commit a robbery. A scuffle ensued and the plaintiff was shot in the neck resulting in a quadriplegia. The plaintiff alleged there was inadequate security at the complex which was a cause of the incident. The defendant alleged it was not liable for the incident because the plaintiff was a trespasser to which no duty was owed, engaged in drug dealing at the complex, engaged in felony possession of narcotics at the time of the incident, the assailants were individuals who the plaintiff had previously done and supplied narcotics to, the motive of the robbery was to steal drugs and valuables gained from the prior illegal transactions, and the plaintiff continued to abuse drugs after the incident. After extensive litigation on many issues the case settled shortly before trial.
