$1.0 Million Settlement in Medical Malpractice Action Against Physicians and Hospital For Failing To Timely Diagnose a Perforated Stomach Ulcer

The Plaintiff was a 72 year old adult male who presented to the hospital emergency department complaining of an acute abdomen The hospital radiologist misdiagnosed an abdominal CT as gallstones instead of a perforated stomach ulcer. As a result his condition was not treated and progressed to sepsis which ultimately caused him his death. He was survived by his wife. The hospital and radiologist admitted negligence and offered voluntary arbitration in order to legally limit the plaintiff's noneconomic damages. The case settled for $1 million.
