The Plaintiff was an 18 year old male visiting a high school friend who was a tenant at an apartment complex renting primarily to college students. Another student tenant was having a party in his room which turned into a huge party spilling out into the parking lot. The party was unsupervised involving drugs and alcohol. The Plaintiff and his friends were at that party when a fight broke out between the tenants and other non tenants . Plaintiff attempted to calm both sides down when he was attacked and kicked in the heart by one of the non tenants. The blow caused him to suffer a lethal cardiac arrhythmia. He was survived by his parents. The Personal Representative filed a wrongful death action for negligent security against the owners of the complex. The case settled for $850,000.
