A 10 year old boy was left in the custody of a 60 year old neighbor while the mother went to work. The neighbor had a similarly aged grandson. They decided to go swimming at a nearby apartment which they trespassed on. The neighbor lost sight of the boy who swam into the pool's deep end and tragically drowned. He was survived by his custodial mother and natural father. The neighbor had $75,000.00 in insurance coverage; however, the carrier failed to properly accept the estate's presuit settlement offer for this amount which placed the insured in extreme financial jeopardy. After a civil suit was filed against the insured the carrier settled the case for $1 million.
